PERSONAL DATA PRIVACY NOTICE

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties ("Law"), regarding the obligations of Clínica YoNut, SAS de CV and/or any entities or companies with respect to which directly or indirectly is a majority shareholder (“Clínica YoNut”) with address at Av Acueducto 1170-Interior 16, Chapultepec Nte., 58260 Morelia, Mich. We inform you of the following Privacy Notice.

 

The terms that are identified with a capital initial will have the meaning attributed to them in the Law and/or this Privacy Notice.

OBJECTIVE

The objective of this Privacy Notice is to define the scope and general conditions of the processing of Personal Data and to make them known to the Holders, so that they are able to make informed decisions about the use of their Personal Data, maintaining control and disposition on them. Likewise, the Privacy Notice allows Clínica YoNut to make said treatment transparent and thereby strengthen the level of trust of the Holders.

COLLECTION OF PERSONAL DATA

At Clínica YoNut we obtain Personal Data from our clients, collaborators, candidates and/or suppliers provided by the Owner of the data, by virtue of the relationship generated between it and Clínica YoNut.

 

The Personal Data that is in possession of YoNut Clinic are collected with the objects indicated below:

 

(i) For the correct provision of medical-hospital services, including without limitation hospitalization, surgery, studies, diagnoses, nursing care, pharmaceutical services, blood bank services, hemodialysis, oncological treatments, laboratory tests, radiology and imaging , pathological studies and analyses, therapy, rehabilitation, diet and nutrition and other purposes related to health services.
(ii) For the creation of the clinical file of the Holder of the data, as well as its study, analysis, updating and conservation.
(iii) For the creation of the work file of the Data Holder.
(iv) To carry out the billing and corresponding collection of the services provided.
(v) To carry out studies, records, statistics and analysis of health information.
(vi) To keep records to monitor services, provide services in the future and in general to monitor any contractual relationship that has been generated between the Data Owner and YoNut Clinic.
(vii) To perform various statistical and market analyses, including commercial prospecting.
(viii) To report promotions, discounts, as well as marketing of products and services offered by YoNut Clinic.
(ix) The images and sounds that Clínica YoNut collects through monitoring cameras in its facilities are used for surveillance and security purposes.

 

If a digital account is created, if you wish to express your opposition so that your Personal Data is processed in accordance with the purposes mentioned in item VIII above, you must edit your preferences in the Profile of your account.

 

The Personal Data of the Holders may be collected in the following ways:

i) When the Holder provides them personally or directly to YoNut Clinic either physically or electronically and

ii) When Clínica YoNut obtains them indirectly, through public access sources or legally valid transfers.

 

The Holders are informed that if they use the website of Clínica YoNut (www.clinicayonut.com), text files commonly known as "cookies" will be downloaded and used, through which the following data is obtained: address IP, duration of interaction time on the page, navigation and type of browser. This type of information is generalized and is only used by YoNut Clinic to obtain statistical information on browsing behavior on the website, in order to optimize the design and operation of the system on user devices.

SENSITIVE PERSONAL DATA

YoNut Clinic may collect sensitive data related to health status, background and medical history, lifestyle information and other necessary data (including property data) or convenient for the aforementioned purposes. These sensitive data will be kept and treated with strict security and confidentiality for purposes related to this Privacy Notice, the Law, regulations and applicable regulations.

TRANSFER OF INFORMATION TO THIRD PARTIES

The Personal Data in possession of YoNut Clinic will not be rented or sold to any third party, in the understanding that YoNut Clinic may share Personal Data with third parties in the following cases:

LIMITATION OF USE AND DISCLOSURE OF PERSONAL DATA

YoNut Clinic may limit the use of Personal Data in its possession by means of a request addressed to the company's Data Protection Department, presented by the Holder or his legal representative, at the address located at Av Acueducto 1170-Interior 16, Chapultepec Nte., 58260 Morelia, Mich. de Ocampo, or through the corresponding request sent to the email contacto@clinicayonut.com

EXERCISE OF ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION)

The Holder or his duly empowered legal representative, has the following rights in relation to the Protection of Personal Data:

 

Access: You can request YoNut Clinic to inform you about what data and information of yours it has and how it has been obtained. In terms of article 33 of the Law, the right of access will be fulfilled, in any case making available to the Holder, in the facilities where the service has been provided by YoNut Clinic, the documents that contain the data collected (including the corresponding clinical file).

 

Rectification: You may request YoNut Clinic to notify you of any or all data (such as: change of address, name change, telephone change) due to their being incorrect or inaccurate.

 

Cancellation: You can request YoNut Clinic to stop processing data that is unnecessary or not relevant for the purpose for which it was collected. The data may be blocked, that is, it will be identified and reserved in order to prevent its treatment.

 

Opposition: You may oppose the processing of your Personal Data included in the YoNut Clinic database, even if the processing of your data is lawful.

 

To exercise the aforementioned ARCO Rights, the Holder or his duly empowered legal representative must send a written request addressed to the YoNut Clinic Data Protection Department, at the address located at Av Acueducto 1170-Interior 16, Chapultepec Nte., 58260 Morelia, Mich. de Ocampo or to the email contacto@clinicayonut.com, clearly indicating the right that is being exercised as well as the following information:

-Name of owner.
-Domicile of the Holder or email to which a response can be given.
-Documents proving the identity or authorization to represent the Data Owner.
-Description of Personal Data on which you intend to exercise any ARCO Right
-Any other element that facilitates the location of Personal Data.
-In case of requesting a rectification of Personal Data, the modifications to be made must be indicated, providing the documentation that supports the request.

 

YoNut Clinic will respond to the request regarding access, rectification, cancellation, opposition, revocation of consent and/or limitation of the use or disclosure of your Personal Data within the terms established by Law.

YoNut Clinic has the right to make changes or updates to this Privacy Notice at any time, due to legislative reforms, internal policies or new requirements for the purposes described.
